SECTION20 provides document generation, deadline tracking and audit-log tools. It does not provide legal advice and is not a substitute for professional advice from a solicitor or surveyor. You remain fully responsible for the content of any notice you serve on leaseholders and for compliance with the Landlord and Tenant Act 1985 and the Service Charges (Consultation Requirements) (England) Regulations 2003.

1. Your account

You are responsible for keeping your login credentials secure and for anything done through your account. You must be at least 18 and be authorised to act for the landlord, RMC, freeholder or managing agent whose consultations you administer using the service.

2. Data processing

When you enter leaseholder personal data (names, addresses for service, optional emails), you are the data controller for that data and Fixshtel Ltd is your data processor. We process it solely on your instructions to provide the service — generating notices, tracking deadlines and maintaining a service and audit log. We do not use it for anything else.

You confirm that you have a lawful basis under the UK GDPR to enter leaseholder personal data — typically the legal obligation to consult under the Landlord and Tenant Act 1985, or a legitimate interest in serving statutory notices as landlord, agent or RMC.

We will act only on your documented instructions (embodied in these terms and in-app actions), will keep the data confidential, will apply appropriate technical and organisational measures, and will assist you with data subject requests concerning leaseholder data. 3. Payments, subscriptions and suspension

Pay-per-notice: unlocking a single consultation is a one-off £39 GBP payment. Bundles of 3 (£99) and 5 (£149) credits are also available. Credits do not expire. Because the service is a digital tool delivered immediately on unlock, statutory cancellation rights for distance sales are waived once you unlock a consultation or a credit is spent.

Unlimited subscription: £29 GBP per month or £299 GBP per year, billed in advance and renewing automatically on the same day each billing period until cancelled. You can cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period and you keep access until then. We do not issue refunds for part-used billing periods.

Failed payments and suspension: if a subscription payment fails, we (via Stripe) will retry the charge and email you reminders on days 1, 5, 10 and 13. If payment is not successful within 14 days of the first failure, your account will be automatically suspended: you will still be able to sign in and view your existing consultations, records and audit logs, but you will not be able to create or serve new notices until payment is restored. Access is reinstated automatically as soon as a successful payment is taken.

All payments are processed by Stripe. If a payment goes through but your account is not updated within a reasonable time, contact us at info@fixshtel.co.uk.

4. Acceptable use

Do not use the service to process personal data for purposes unrelated to Section 20 consultations. Do not attempt to reverse engineer, resell, or circumvent the payment controls in the service.

5. Availability and liability

We aim for high availability but do not guarantee uninterrupted service. To the extent permitted by law, our total liability under these terms is limited to the fees you have paid to us in the twelve months preceding the claim. Nothing in these terms limits liability that cannot lawfully be limited (including for fraud or death or personal injury caused by negligence).

6. Termination and deletion

You can delete a consultation or your entire account at any time from within the app. Deletion is permanent. If you may need any of your consultation records as evidence at a First-tier Tribunal (Property Chamber), download or export them before deleting — retaining tribunal evidence is your responsibility as the controller.

7. Changes

We may update these terms as the service evolves. Material changes will be notified to account holders by email or in-app.

8. Governing law

These terms are governed by the laws of England and Wales, and disputes will be resolved by the courts of England and Wales.
